Alton & Southern worker claims back injuries after backhoe tips

Alton & Southern Railway machine operator Curtis Graham claims back injuries after a backhoe he was operating to remove snow from a parking lot in East St. Louis turned on its side.

Graham filed a Federal Employers' Liability Act suit in St. Clair County Circuit Court June 26 claiming his employer failed to warn or mark the edges of a parking lot.

He also claims the railroad failed to provide him with a reasonably safe place to work.

According to the complaint, the backhoe Graham was operating on Feb. 2 went into a ditch.

Represented by Michael G. Burnworth of Blunt & Associates in Edwardsville, Graham claims lost wages, medical expenses and permanent, painful and progressive injuries. He is seeking in excess of $100,000 in damages, plus costs of the suit.
